TOWN ORDINANCE TO REGULATE BONFIRES,

BRUSH AND GRASS FIRES IN THE

 TOWN OF PERTH

 
            BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Perth, Fulton County, New York as follows:
 
(1)            Bonfires Prohibited. No person shall kindle or maintain any bonfires or knowingly furnish the materials for any such fires, or authorize or permit any such fires to be kindles, or maintained, or burn or cause to be burned any wastepaper, hay, grass, weeds, litter, excelsior, shavings, trash, junk, lumber, leaves, straw, or any other combustible material in any road, alley, or within 20 feet of any building in the Town of Perth, without first obtaining written permission to do so from the fire chief, or in his absence, the assistant chief or other person in charge , whose company is primarily responsible for the general safety and protection, whether by contract or otherwise, of the persons and property in the immediate vicinity of the proposed fire, unless such burning shall be done in metallic or other noncombustible receptacles with covers and screens, and under such proper safeguards as the chief may direct.
 
(2)         Brush and Grass fires. No person shall kindle any fire or furnish materials for any fire, nor in any way authorize or allow any fire to be made, or in any manner, aid or assist in making any fire in any field or other tract of land situated in the Town of Perth, for the purpose of clearing said field or tract of standing brush, grass or other matter without first obtaining written permission to do so from the chief or in his absence, the assistant chief, or other person in charge, whose company is primarily responsible for the general safety and protection, whether by contract or otherwise, of the persons and property in the immediate vicinity of the proposed fire. These restrictions do not apply to the burning of rubbish in metal containers nor to the clearing of highways of brush by town, county, or state highway employees, nor to any individual who cuts and piles such materials, provided they are not burned in a field or area where there is standing grass, brush or other standing matter.
 
(3)      Powers and Duties of Fire Chief.    It shall be the duty of the fire chief, before giving any permission to do any of the acts restricted by this ordinance, to ascertain the precautions said person proposes to take to keep the proposed fire under proper control. The fire chief shall withhold permission unless he is satisfied that conditions at that time are such that the proposed fire is not likely to escape control.
 
(4)      Violation of Ordinance; Penalty. Any person who commits or permits any acts in violation of any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction shall be subject to a fine of not more than $50.00 or imprisonment not exceeding ten days, or by both such fine and imprisonment.
